Three important reasons you want to focus on compliance:
- The federal government has financially incentivized each State Attorney General (SAG) to investigate and prosecute every HIPAA complaint. You should also understand that the lion’s share of the fines recovered will largely stay within the state boundaries; thus they are financially motivated to pursue every complaint. The SAG’s, essentially, have evolved into the HIPAA police, and they now have financial incentive to pursue you.
- The Office of Civil Rights has included business associates in their 2015 audit plans. You can expect enforcement actions and know that many business associates have in fact, caused breaches.
- Class action lawsuits have been in the state courts recently. Some states have awarded damages to the individuals that had their information ‘breached’, even when a breach by definition did not occur. Here is their reasoning. Simply because the information ended up in someone’s hands that it wasn’t supposed to, they felt it was a breach. However, no financial, reputational harm or identity theft happened. These are the 3 qualifiers of a HIPAA breach, but even though none of these things happened, monies have been awarded. In other cases, the state courts have rejected the request for financial damages because it could not be proven that there was an actual breach (again, see the 3 qualifiers).
